The Italian government led by Giorgia Meloni issued a security decree on Tuesday evening, after looting in Milan and unrest in several cities during protests against the rising cost of living. The text, made up of eight articles, was approved by the Council of Ministers.

The most significant measure is the creation of a new offence, called organised violence at public demonstrations. It punishes anyone who, during a protest, uses sticks or clubs or throws objects that endanger other people's safety. The penalty ranges from two to five years in prison, along with a fine of up to 20,000 euros. The penalty increases if the offenders act with their faces covered or cause damage to infrastructure or public services. Anyone who organises or promotes, including through digital tools, the formation of groups intended for violent demonstrations faces four to twelve years in prison.

The decree also extends preventive detention to anyone who disturbs security in places with large crowds. This measure will also apply to minors, but only from the age of 16. The use of delayed arrest in the act is likewise expanded.

Regarding the criminal responsibility of minors, the decree takes up a provision already included in an earlier bill: minors who have turned fourteen are presumed capable of understanding and intent, and therefore become immediately liable, without any need to verify this capacity at the time of the act.

Fines for parents and troops in Milan

The measure also introduces fines of between 500 and 1,000 euros for parents of minors, even those not criminally liable, if their children commit acts of violence during demonstrations. The amount can double for repeat offences.

Finally, the government has decided to send 500 soldiers to Milan immediately, who will remain in the city until 31 December. The planned cost is 4.7 million euros. According to Interior Minister Matteo Piantedosi, the contingent will be made available to public security authorities to support territorial control and public safety in the city.
